Com uma canetada, desembargador suspende 78 ações contra Kayatt

Com uma canetada, o desembargador Amaury da Silva Kuklinski suspendeu 78 de 81 ações por improbidade administrativa contra o conselheiro do Tribunal de Contas de Mato Grosso do Sul, Flávio Kayatt, ajuizadas pelos promotores de Justiça de Ponta Porã, Gabriel da Costa Rodrigues Alves e Gisleine Dal Bó. As ações trancadas por Kuklinski incriminavam Kayatt de promover contratação temporária de médicos em Ponta Porã, na condição de prefeito, sem o preenchimento de determinados requisitos legais.

Na decisão liminar, Kuklinski fez duras críticas aos promotores de Justiça por perseguição a Kayatt. Para o desembargador, o Ministério Público poderia ter distribuído as ações em uma única operação, englobando todos os médicos temporários que prestaram serviços durante o mandato de prefeito (2005 a 2012). Mas os promotores de Justiça preferiram individualizar cada ação para dificultar a defesa de Kayatt.

O desembargador observou essa manobra dos promotores de Justiça com intuito de incriminar Kayatt de toda maneira. Para ele, colocar o conselheiro 78 vezes no polo passivo revela “verdadeiro excesso acusatório, prejudicando claramente os princípios do contraditório e da ampla defesa do impetrante [Kayatt]”.

Com 81 ações ajuizadas contra Kayatt, Kuklinski anotou ainda, em sua decisão, a “total despreocupação” dos promotores de Justiça “com os princípios da boa fé processual, do devido processo legal, da celeridade e economia processuais e da paridade de armas”.
